Recently, there has been confusion in town over the right to develop the “residual development potential”. The notorious one may be what culminated in the saga at Mei Foo Sun Chuen. Now with the judgment of Re: Ho Mei Ling, HCAL 51 of 2011 delivered on 29 August 2011 and the dispute on the development at Ying Wa Terrace, i.e. Building Authority v. Dobrowen Investment Limited & Appeal Tribunal (Buildings), HCAL 20 of 2011 in the pipeline, it is time to review the arguments on what is a “site” for the purpose of the Building (Planning) Regulations.

Mr. Lawrence Pang is going to share his experience and analyse the background of the cases so as to give an overview on the issues. Right to light, a topic which has before not been applied in Hong Kong, may have implication on the further development of these cases.
