講師 : Mr. Damon So

Damon is a Partner with the Construction & Engineering Practice of the international law firm Hogan Lovells. He initially qualified as a Chartered Civil and Structural Engineer and is a Member of the Hong Kong Institution of Engineers. Since he subsequently also qualified as a solicitor specializing in construction law, Damon has undertaken a wide range of construction related legal work and has had occasion to consider many of the issues which typically arise in respect of various construction projects. He has handled a number of construction related litigation and arbitration proceedings over the years. He has been involved in advising and drafting construction, joint venture, consultancy and other related contracts for contractors, employers and consultants in respect of a number of building and civil projects. He has spoken widely on topics relating to construction legal issues for various professional organizations and professional and engineering companies. He is a Fellow of the Hong Kong Institute of Arbitrators and the Chartered Institute of Arbitrators and acts as an arbitrator. He is a co-author of leading textbooks on arbitration namely "The Annotated Ordinances of Hong Kong – Arbitration Ordinance (Cap. 609)" and "Butterworths Hong Kong Alternative Dispute Resolution Handbook" both published in 2014.

This year we saw the introduction of the Contracts (Rights of Third Parties) Ordinance (Cap 623) into Hong Kong.  It introduces exceptions to our traditional doctrine of privity of contract.  Potentially strangers may be able to make a legal claim under a contract which they do not sign or to which they are not a party.  Why do we need this Ordinance?  What are the implications for our usual construction contracts and consultancy agreements?  Is there a way to use it to the advantage of the party you are representing or yourselves in the negotiation and drafting of contracts?  The speaker will explore these issues in this talk.
