Speaker	:	Ms Rachael Guan is a lawyer in Hogan Lovell's Projects (Engineering and Construction) practice. She specializes in the preparation of construction and engineering contracts, and in the course of practice has advised in relation to different types of project - commercial buildings, hospital, schools, roads and power stations. Mr Tony Kwok is a charted quantity surveyor with experience in different types of project - water, highways, buildings drainage and aviation. He works in EC Harries (Hong Kong), predominantly working on NEC advice and implementing, having gained extensive experience on the use of various NEC forms in UK.

Details	:	The NEC form of contract is gaining an increasingly high profile in Hong Kong. The Hong Kong government is currently trailing the use of the NEC form of contract in Hong Kong. Likewise, there is also increasing private sector uptake of the form. The NEC form of contract is unlike other standard forms of contract – it depends from usual legal styles of language incorporates project management techniques and has a different risk profile from other commonly used forms of contract. Parties who use it often want to bring about an improvement in and costs of project delivery and the attitudes of contracting parties. But how effective is it? What issue should parties take into account when contracting on an NEC basis? Rachel Guan of Hogan Lovells and Tony Kwok of EC Harris, who have both spoken to HKIS before, return to offer their insights. Rachael will offer a legal practitioner’s thoughts on the benefits and risks of the form, and Tony will offer tips from his experience of using the form in practice.

1.	The registration fee is non-refundable and non-transferrable.
2.	A registration number will be generated for each application. The registration number is unique and non-transferrable. Members cannot proceed to payment if they do not apply the CPD event and obtain the registration number through the HKIS website.
3.	Payment can be made by cheque or by Credit Card (Shanghai Commercial Bank Ltd. / American Express). Cheques should be made payable to “SURVEYORS SERVICES LTD.”. A separate cheque or Credit Card payment instruction form is required for each event/ application. You should write down the registration number and HKIS membership number at the back of your cheque. The HKIS Secretariat will update the payment status and your application will be confirm when HKIS Secretariat receive your payment.
4.	Payment by PayPal is also acceptable. Please register in our web site before the closing date for each event. Please be reminded that if you cannot settle the payment within 7 days from the date the HKIS Secretariat accepted your registration, your registration number will be invalid and your application will be rejected. Your name will not be included in the registration list and you cannot attend the concerned CPD event. (Not applicable for site visit / social event / joint event with other organisation)
5.	An official receipt which must be presented at the event, will be available for downloading from the "CPD Profile" under Members Corners when payment is received.
6.	Incomplete or wrongly completed registration will not be processed.
7.	In the event a Typhoon Signal No. 8 or above or Black Rainstorm Warning is hoisted, the event will be postponed and a new arrangement will be announced. Should the aforesaid warnings be lowered 4 hours before the event, the event will proceed as normal.
8.	If you have not received any reply from HKIS Secretariat within 7 days of the event, you may call the Secretariat at 2526 3679 to check the progress of your registration.
9.	The HKIS reserves the right of final decision and interpretation in the case of any disputes.
