Mr. Joseph Chung

Joseph had practised as a barrister for many years before he became a solicitor in 2001. Over the years in his practice as a lawyer, he has been involved in many high profile construction projects, including the Hong Kong airport core project. Joseph has acted for developers, contractors, sub-contractors and project consultants. He is listed on the Hong Kong International Arbitration Centre’s List of Arbitrators and is on the Panel of Arbitrators of The Kuala Lumpur Regional Centre for Arbitration. Joseph sat as Deputy District Court Judge for a period in 2012. Joseph regularly gives talks on a wide range of construction topics including NEC. Mr. Allen Lai

Allen Lai is the Senior Consultant of Charlton Martin Consultants Limited. He is a qualified quantity surveyor with over 20 years experience in the construction industry working on building, engineering and E&M projects. He is frequently involved in preparation of expert evidence. Allen has also been involved in the implementation of the NEC for various work departments and utility company’s projects. He has provided a number of in-house training workshops and public seminars on NEC, and had delivered a seminar providing an insight on the use of NEC3 ECC and TSC to the HKIS, and workshop to RICS. He also serves on the Committee of Young Members Group of Chartered Institute of Arbitrators East Asia Branch.

NEC is often promoted as being clear and simple. Has NEC been able to achieve that purpose? The objective of this talk is to highlight potential interpretation problems in NEC. This talk will analyse the topic with particular focus on important provisions such as Core Clause 10.1 (“spirit of mutual trust and co-operation”) and administering compensation events. The talk will also highlight potential pitfalls in the wordings used in NEC in comparison with traditional forms of contracts.
