Mr. Fan is both a qualified Quantity Surveyor and a practicing barrister. He is also a fellow member of Chartered Institute of Arbitrators. Prior to commencing his full practice as barrister in 2005, he has been working in the building and construction industry in the positions of contract consultant and quantity surveyor for more than 15 years. Because of his past occupation, he has obtained considerable experience and substantive know-how relating to construction contracts administration, procurement matters, tendering, contractual claims, EOT/delay analysis, project management, expert witness report and quantity surveying in various infrastructure and building construction projects in Hong Kong as well as overseas including PRC, Macau, Vietnam, Singapore, Australia, Saudi Arabia, Ethiopia and Lebanon. He practices mainly on construction / commercial litigation as well as arbitration proceedings.

In this talk, the speaker would like to share his view / experiences related to the following areas:

 

  1. When ascertaining the Contractor’s loss and/or expense claim, would the Surveyor be inhibited from discharging his/her duty by virtue of personal data privacy claimed by the Contractor? What kinds of contemporary records that the Contractor would be required to keep?

  2. Would a genuine accidental arithmetical error made by the Surveyor during ascertainment of the Contractor’s loss and/or expense claim become final and binding on the Employer and the Contractor?

  3. Whether or not such a genuine accidental arithmetical error made by the Surveyor could be corrected or amended?

  4. Would the Surveyor be liable to the Employer or the Contractor for negligence by reason of such mistake?

  5. When the Surveyor’s ascertainment of the Contractor’s loss and/or expense claim shall become final and binding on the Employer and Contractor?
