The Government of the HKSAR has actively promoted the use of Building Information Modelling (“BIM”) in major capital projects in its Policy Address 2017. While BIM appears to be a world-wide and irreversible trend, local employers, consultants, contractors and subcontractors are concerned with their risks and liabilities when using BIM. Therefore, proper contract conditions setting out the obligations, responsibilities and liabilities of the contracting parties are essential for successful implementation of BIM. In responding to this industrial need, the HKIS QSD has drafted standard conditions of contract for BIM.

 

 

In this consultation forum, Dr Ho will outline the proposed BIM contract conditions which will include the general provisions, priority of contract documents, obligations of the project participant, digital data and BIM management, BIM execution plan, risk allocation in respect of the model, intellectual property rights of the model, indemnity and insurance, and termination, recession or expiry of the agreement. While explaining the rational of each contract condition, Dr Ho will also briefly compare the proposed BIM contract conditions with some overseas BIM contracts such as UK’s CIC BIM Protocol, US’s AIA BIM and Digital Data Exhibit and Singapore’s BIM Particular Conditions. As a consultation forum, participants are expected to actively contribute their views so as to sharpen the proposed BIM contract conditions for building a better way.
