Abstract

For main contractors, passing of appropriate risks onto subcontractors is an important part of risk management. He will want to pass on as much of the risks associated with any subcontracted portions of the works as possible, in order to reduce his own exposure to employer. Where appropriate risks are passed, it ensures that the person best able to control the risk also has the strongest incentive to control the risk. Against this context, the seminar endeavours to explore effective ways of subcontracting and imposing obligations on the subcontractor on a "back to back" basis.
