Mr. Fan is both a Chartered Quantity Surveyor and a practicing barrister. He is also a fellow member of Chartered Institute of Arbitrators. Prior to commencing his full practice as barrister in 2005, he has been working in the building and construction industry in the positions of contract consultant and quantity surveyor for more than 15 years. Because of this background, he has obtained considerable experience and substantive know-how relating to construction contracts administration, procurement matters, tendering, contractual claims, EOT/delay analysis, project management, expert witness report and quantity surveying in various infrastructure and building construction projects in Hong Kong as well as overseas jurisdictions including PRC, Macau, Myanmar, Vietnam, Singapore, Australia, Saudi Arabia, Ethiopia, Liberia and Lebanon. He practices mainly on construction / commercial litigation as well as domestic and international arbitration proceedings.

  1. Distinguishing the concept of Variation of Works from Variation of Contract.
  2. Is there any limit of the power to order Variation and/or Omission of Works under the most popular standard form of contracts?  If yes, to what extent?
  3. What would be the consequence if an invalid Variation and/or Omission of Works is ordered?
  4. What would happen if the contractor refuses or fails to execute the invalid Variation and/or Omission of Works?
  5. Is there any remedy available to the contractor for an invalid Variation and/or Omission of Works?
