GPD is pleased to have invited Sr Alnwick Chan, Chairman of GP Division and Mr. Alan Yip, Partner of Mayer Brown to speak on this zoom CPD.

 

On 27 August 2020, Lands Tribunal (“LT”) handed down the judgement on the compulsory sale application case no. LDCS 13000/2019.  It is the first Order for Sale granted in respect of the last minority owner’s unit at Nos 2, 4, 6 & 8 Mount Parker Road which is a Co-opt flat.  The guest speakers are members of the Applicant’s team assisting the LT in reaching the decision.

 

This landmark case attracted attention among the stakeholders and some said that it laid down the foundation for future compulsory sale application of flats developed under the Co-operative Societies Ordinance (Cap 33).  The outcome of this case is also regarded as a test case on whether the alienation restriction, applicable to “Co-opt” flats is a barrier to compulsory sale.


The speakers will focus on their respective specialized areas and share their expert opinions. It will cover areas like history, valuation, premium assessment and the legal arguments in support of an Order for Sale of properties subject to restriction on alienation.

 

Alan and Alnwick both have handled many compulsory sale application cases and accumulated vast amount of experience to share with the audience.
