Mr. Jeffrey Wong is a Managing Director with Secretariat, specialising in consulting on construction projects in the area of quantity surveying. Mr. Wong has analysed, and prepared construction claims for complex construction projects throughout Asia. As a result, he has extensive experience in preparing/assessing prolongation and disruption claims, valuation of variations and re-rating. In addition, he has been appointed as quantum expert and has given evidence at numerous arbitrations and litigations.

Mr. Hinson Cheung is a Senior Associate in Pinsent Masons, and Solicitor Advocate specialising in construction and engineering law. He is dual-qualified as a quantity surveyor and is a member of the HKIS as well as a Fellow of the CIArb and HKIArb. Mr. Cheung has handled numerous arbitrations and litigations involving major infrastructure projects and is experienced in liaising with quantum, programming, structural engineering and geotechnical engineering experts. He is listed on the HKIS HKIA Joint Panel of Arbitrators, and the HKIS Panel of Adjudicators.

Expert evidence is used in litigations and arbitrations to assist the court / tribunal when the case before it involves complex technical issues requiring specific knowledge or experience. Quantity surveyors have been appointed as expert witnesses to give expert evidence in the resolution of many construction disputes.

 

This CPD will introduce the role of an expert witness from the perspective of a quantity surveyor and the following topics will be discussed:

  1. Role of an expert witness
  2. The history and development of expert witnesses under the common law jurisdiction
  3. The duties and liabilities of an expert witness
  4. How an expert witness fulfils his/her duties
  5. What is the common procedure adopted in adducing expert evidence
  6. Single joint expert
